Judge Inclined to Grant Preliminary Approval of $4M Class Action Settlement Against HP

As reported by Law360 (subscription), on January 16, 2025, U.S. District Judge P. Casey Pitts of the Northern District of California  indicated that he was prepared to preliminarily approve a proposed $4 million settlement resolving consumers’ claims against PC giant HP for advertising inflated reference prices on its website.

At the hearing, Judge Pitts called the deal as “very good,” but expressed concerns about a provision in the proposed preliminary approval order which, if issued, would bar class members from filing similar claims against HP pending final approval of the settlement. HP’s counsel agreed to ask her client whether it would accept removing the provision from the proposed order.

In their supplemental briefing in support of preliminary approval, the plaintiffs noted that the proposed settlement “provides a larger recovery for the class on both an individual and aggregate basis” than comparable deceptive pricing class action settlements against computer manufacturers Dell and Lenovo.
