EDGE Files Lawsuit against Nixplay for Bait-and-Switch Advertising

On April 22, 2025, EDGE filed a lawsuit against Nixplay, Inc., a leading digital photo frame company, on behalf of three individuals seeking public injunctive relief, to remedy what they allege are bait-and-switch advertising practices.

As the Complaint sets out, Nixplay for years advertised that its digital photo frames came with unlimited photo cloud storage, five gigabytes of video cloud storage, and integration with Google Photos and Dropbox—all at no additional cost, with “no subscription necessary.” These features were prominently displayed in Nixplay’s marketing, leading millions of consumers to believe they could enjoy them without paying recurring fees. And for a time, Nixplay lived up to its promises.

But in March 2025, Nixplay chose to place profits over promises, the Complaint states. Nixplay announced it was “updating” its free plan by slashing users’ photo and video storage to just half a gigabyte—a fraction of the amount that was promised. User content exceeding that limit would be locked unless users paid a subscription fee. Additionally, as part of the “update,” integration with Google Photos and Dropbox would now only be available to paying users.

“Companies don’t get to change the rules years after the game has started,” said Natasha Dandavati, an attorney with EDGE who represents the plaintiffs in the case. “Nixplay made clear, repeated promises that users would enjoy cloud storage and app integrations without a subscription. It doesn’t get to take those promises back just to boost profits.”

The lawsuit was filed in the Superior Court of the State of California, County of Santa Clara. The plaintiffs seek public injunctive relief, including an order requiring that Nixplay unlock their restricted content and honor the promises it made regarding the features included with its digital photo frames. The plaintiffs further seek an order prohibiting Nixplay from engaging in similar deceptive practices in the future.
